Please read these Terms of Service carefully before using the Webtechgen website or engaging Webtechgen as a service provider — including our role as a Meta Tech Provider for client businesses. By accessing or using this site, you agree to be bound by these terms.

1. Acceptance of Terms

By visiting webtechgen.com or submitting any form on this site, you confirm that you are at least 18 years old and that you accept these Terms in full. If you do not agree with any part of these Terms, you must not use the site.

2. Description of Service

The Webtechgen website is a marketing website that provides information about our software development services and allows visitors to:

  • Browse information about our capabilities and portfolio
  • Submit enquiries via the contact form
  • Subscribe to updates or newsletters (where offered)

The site does not constitute an offer of employment, a binding contract for services, or a guarantee of project availability. Formal engagements are governed by separate written agreements signed by both parties.

3. User Conduct

When using this site, you agree that you will not:

  • Submit false, misleading, or fraudulent information through any form
  • Use the site to send unsolicited commercial communications (spam)
  • Attempt to reverse-engineer, scrape, or systematically copy any content from the site beyond what is reasonably necessary to browse it
  • Upload or submit malicious code, scripts, or content designed to disrupt the site or its users
  • Use the site in any way that violates applicable local, national, or international law or regulation

We reserve the right to block access to the site for any person who violates these conduct rules.

4. Intellectual Property

Our content

All content on this website — including text, graphics, logos, photography, code, and design — is the property of Webtechgen or its licensors and is protected by Indian and international copyright law. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

Your submissions

When you submit an enquiry, project brief, or any other content through our contact form, you represent that:

  • You own or have the right to share that content
  • Sharing it does not infringe any third-party rights

You grant us a limited, non-exclusive licence to use that content solely for the purpose of evaluating and responding to your enquiry.

4A. Tech Provider Services (WhatsApp, Meta Ads, Pages, Instagram, Lead Ads)

Webtechgen offers services that involve operating client accounts on Meta platforms — WhatsApp Business API, Facebook Pages, Instagram business accounts, Meta Ads Manager, and Lead Ads — as a Meta Tech Provider. Engagements for these services are subject to a separate signed services agreement and Data Processing Addendum, but the following baseline terms always apply.

Client authorization required

We do not access any client Meta account, page, ad account, WhatsApp Business Account, or Platform Data without:

  • A signed written services agreement
  • The client adding Webtechgen as a Tech Provider in their Meta Business Manager
  • A documented list of the specific Meta permissions granted

The client retains ownership of every Meta asset (Business Manager, ad account, page, Instagram account, WhatsApp Business Account, phone number, and registered domain) at all times. Access can be revoked by the client at any time from Meta Business Manager.

Compliance with Meta policies

When delivering Tech Provider services, Webtechgen complies with:

Clients are responsible for ensuring that the content, products, and audiences targeted through these services also comply with Meta policies. Webtechgen will refuse to publish or run any content that we reasonably believe violates Meta policies or applicable law.

Platform Data handling

Data we receive from Meta on the client's authorized accounts ("Platform Data") is processed solely to deliver the agreed services. Detailed handling, retention, and deletion rules are described in our Privacy Policy and the per-engagement Data Processing Addendum.

No guaranteed outcomes

Tech Provider services depend on Meta's platforms, policies, and review processes. We cannot guarantee:

  • Approval timelines for Meta Business Verification, WhatsApp display names, or message templates
  • Specific ad performance outcomes (CPM, CPC, ROAS, lead volume)
  • That a Meta-imposed restriction, ban, or rate limit will not affect a client account

We will, however, exercise reasonable professional skill and follow documented playbooks designed to minimize these risks.

Termination & handover

Either party may terminate a Tech Provider engagement under the terms of the signed services agreement. On termination:

  • We remove ourselves from the client's Meta Business Manager within 5 business days
  • Platform Data we have processed is deleted within 30 days, except where retention is required by law or by the client
  • Documentation, runbooks, and audit logs are handed over to the client

5. Third-Party Links

Our site may contain links to third-party websites. These links are provided for convenience only. We have no control over the content or practices of third-party sites and accept no responsibility for them.

6. No Warranties

The site is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The site will be uninterrupted, error-free, or free of viruses
  • Any information on the site is accurate, complete, or current

7. Limitation of Liability

To the maximum extent permitted by applicable law, Webtechgen shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the site — including but not limited to loss of profits, data, or goodwill.

Our total liability to you for any claim arising from use of this site shall not exceed INR 5,000 (Indian Rupees five thousand).

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, to the extent such limitation is prohibited by law.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising from or related to these Terms or your use of the site shall be subject to the exclusive jurisdiction of the courts located in Lucknow, Uttar Pradesh, India.

9. Changes to These Terms

We reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the site after the effective date of any changes constitutes acceptance of the updated Terms.
